These Terms of Use (“Terms”) govern your access to and use of the SeeYou software and services (collectively, “Services”) provided by Naviter (“we,” “us,” or “our”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.
1. Acceptance of Terms
By downloading, installing, or using the Services, you confirm that you have read, understood, and agreed to these Terms, as well as our Privacy Policy. If you do not agree to these Terms, you may not access or use the Services.
2. Eligibility
You must be at least 18 years old or have the consent of a parent or legal guardian to use the Services. By using the Services, you represent that you meet this requirement.
3. License Grant
Naviter grants you a non-exclusive, non-transferable, revocable license to access and use the Services for personal or professional purposes, in accordance with these Terms. This license does not allow for commercial redistribution or resale of the Services.
4. User Account and Responsibilities
- Account Creation: To access certain features, you may be required to create an account. You must provide accurate and complete information during registration and keep it up to date.
- Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of unauthorized use.
- Prohibited Uses: You agree not to misuse the Services, including but not limited to attempting to disrupt, hack, or reverse engineer the software.
5. Payments and Refunds
- Payments: The Services may include paid features or subscriptions. Payments are processed through third-party platforms, such as the Apple App Store or Google Play Store. By making a payment, you agree to the respective platform’s terms and conditions.
- Refunds: Refunds for purchases made through the Apple App Store are processed by Apple. By using our Services and making purchases through the Apple App Store, you consent to Apple handling refund requests via RevenueCat, our subscription management platform. Naviter is not responsible for refunds processed by Apple.
6. Modifications to the Services
We reserve the right to update, modify, or discontinue the Services at any time without prior notice. We will not be liable for any modifications, suspensions, or discontinuations.
7. Termination of Use
We may suspend or terminate your access to the Services at our sole discretion, without prior notice, if you violate these Terms or engage in conduct we deem inappropriate. Upon termination, your license to use the Services will immediately cease.
8. Intellectual Property Rights
All intellectual property associated with the Services, including software, designs, text, and trademarks, belongs to Naviter or its licensors. You may not reproduce, modify, or distribute any materials without prior written permission.
9. Privacy
Your use of the Services is subject to our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the Services, you consent to the data practices described in the Privacy Policy.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Naviter is not liable for any indirect, incidental, consequential, or punitive damages, including loss of data, revenue, or profits, arising out of your use or inability to use the Services.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of Slovenia. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of Arbitration Court of the Chamber of Commerce and Industry of Slovenia (ACCCIS).
12. Amendments
We may revise these Terms from time to time. If changes are significant, we will notify you via email or through the Services. Continued use of the Services after such changes constitutes your agreement to the updated Terms.
